Business Terms and Conditions

Introductory Provisions

The business terms and conditions specified below apply to the PANTHER-STORE e-shop, which is run by David Maršálek, Boettingrova 40, 636 00 Brno.

Purchase Orders

Only the items specified in the sales contract purchase order shall be considered the subject of the contract. Dimensions and other information indicated on our website, in catalogues, leaflets or other printed matters shall be understood as non-binding. In case of any discrepancy, you will certainly be contacted. We undertake to supply to our customers only items in perfect condition that meet the specifications and features common for the particular type of item, which comply with the relevant standards, regulations and laws applicable in the Czech Republic.

You are required to complete all the information and data requested in the purchase order form, otherwise, the electronic purchase order is not valid.  Before a sales contract can be made, a formal purchase order acknowledgement from the seller by e-mail via the basket is required.

In case of certain, especially higher value purchase orders, in order to make the sales contract, the seller reserves the right to have the purchase order acknowledged in person or by phone and to receive an advance payment from the buyer. 

Should the exchange rate or the price charged or the assortment supplied by the supplier change considerably between the time when the purchase order is made and the items are delivered, our company has the right to modify the purchase order upon agreement with the buyer, or to unilaterally withdraw from the contract with immediate effect. 

Purchase Order Acknowledgement and Delivery Time

Purchase orders are processed every business day. In case of any ambiguities, you will certainly be contacted.

The basic delivery time is usually 3 business days for items we have in stock, i.e. smocks, caps, helmet covers, shirts, tarpaulins and accoutrements. Jackets and trousers are delivered within 4 to 8 weeks depending on the type and quantity of item ordered. Should this delivery time be prolonged due to an unpredictable event, we will inform you by e-mail or by phone.

 

Purchase Order Cancellation

The seller reserves the right to cancel the purchase order or its part only for items that are not produced or delivered any more or if the price of the items charged by their supplier changes considerably.

The buyer has the right to cancel the purchase order without giving any reason at any time before its final acknowledgement (purchase order status: „Purchase order is being processed"); after its binding confirmation, this is possible only upon agreement with the seller or if the seller fails to fulfil the stipulated delivery terms and conditions. 

The buyer has the right to withdraw from the sales contract within 14 days of receiving the item(s) in accordance with the Civil Code, as amended. If the buyer decides to exercise this right, he must deliver the withdrawal notice to the seller not later than within 14 days of receiving the item(s). The buyer is obliged to return the item(s) complete, with all the documentation, undamaged, clean and possibly including the original packaging, in the condition he received it. Should the returned item(s) be incomplete or damaged, the seller may reduce the purchase price reimbursed to the buyer by the corresponding amount (in accordance with s. 458 (1) of the Civil Code). The money for the returned item(s) will be reimbursed to the buyer within 30 days of the day when the buyer's withdrawal from the contract becomes effective. Only items of standard size can be returned. Items made to order as per the customer's specifications cannot be returned. Such items have specific dimensions and are not saleable for the producer.

Claims

New items are covered by a warranty of 24 months from the date of delivery of the item to the buyer. If the buyer identifies any defect upon receipt of the item, he must notify PANTHER-STORE of such fact always in writing, by post or e-mail, without undue delay. This needs to be done not later than within 3 days of receiving the item.

The seller shall not be liable for any damage arising from use of the products, their functional characteristics or improper use of products, or caused by external events, improper handling or common wear and tear. The provided warranty shall not apply to defects of such origin.

How to Proceed in Case of a Claim:

  1. Notify us of the claim by e-mail at info@panther-store.cz) or by letter to our postal address.
  2. Send the item(s) as a registered parcel (not as a cash on delivery parcel) to our address.
  3. Indicate the reason for the claim, your address, and enclose a copy of the receipt confirming that you purchased the item(s) from our e-shop.

These warranty terms and conditions are governed by the seller's Claim Rules and the relevant legal regulations applicable in the Czech Republic. The purchase receipt shall serve as the warranty card.

Non-Acceptance of an Item(s)

Should the buyer refuse to accept any item(s), the seller shall have the right to apply, with respect to the buyer, a contractual fine of 2 % of the invoiced amount plus postage for delivery back to the seller.

Personal Data Protection

Any personal data or contact information provided while making a purchase order for a particular item are intended only for the purposes of the PANTHER-STORE e-shop, which treats them in compliance with Act No. 101/2000 Sb. (Collection of Laws), on personal data protection. Personal data (such as name, address, telephone number, e-mail, company registration number, VAT number, etc.), which are part of the purchase order or which have been communicated during the registration process by the buyer, are considered confidential information and are protected against misuse. Such personal information about buyers will not be disclosed to any third party other than those directly involved in the purchase order processing (operators, carriers, etc.). However, personal data will be provided to such third parties to the necessary extent only. The buyer agrees that information about the buyer and the transactions made by the buyer provided while using the e-shop will be collected, archived and used under the above-specified conditions. The seller is obliged to cancel any registered buyer from the database upon the buyer's request submitted in writing, by e-mail or by phone.

Final Provisions

These Business Terms and Conditions shall apply in the version presented on the seller's website on the day of sending the electronic purchase order to the buyer. Any images, pictures or text used on our website are the intellectual property of PANTHER-STORE and may not be used without the company's prior consent.
